TERMS OF USE
The agreement between you and MeKiosk.
These terms apply to everyone who uses MeKiosk: sellers who run a store (sections 3 to 10) and buyers who order from one (section 11). They apply to every version of MeKiosk, from test versions to the full public release, and they're subject to change (section 1). How we handle personal data is in our privacy policy.
1. About these terms
These terms are the agreement between you and Novelite Imperia Consult ("MeKiosk", "we", "us"), whether you sell on MeKiosk or buy from a store on it. They apply to the MeKiosk app, every store at a mekiosk.shop link, and everything else we provide, at every stage of MeKiosk's release: test versions, early access for sellers we invite, and the full public service.
- Accepting them: sellers accept these terms when they agree to them while setting up their store, or by using MeKiosk to sell. Buyers accept them by placing an order on a MeKiosk store, or by paying for an order a seller sent them. If you don't agree, don't use MeKiosk.
- Privacy: our privacy policy explains what personal data we collect and why. It forms part of these terms.
- Age: you must be 18 or older to sell on MeKiosk.
- Who we are: Novelite Imperia Consult, Madina, Accra, Greater Accra Region (GhanaPost GPS GM-021-6800). Message us through the support button in the app, or email support@mekiosk.store.
What MeKiosk does
MeKiosk lets you open an online store, list your products, share links and status images, and take Mobile Money payments through Paystack's checkout. Each payment is matched to its order automatically, so you can see who paid.
- We are not part of the sale. Each sale is between the seller and the buyer. The seller is responsible for their products, their prices and delivery.
- We don't hold the money. Paystack, our payment provider, collects each payment and pays the seller's share to their MoMo wallet. MeKiosk receives only its fee (section 5).
Changes to these terms
These terms are subject to change. We may update them as MeKiosk grows, for example when we add or change features, set or change our fees, or when the law changes. We'll tell you by text or in the app at least 30 days before a change that affects you takes effect, unless the law requires it sooner. The date at the bottom of this page shows when they last changed.
If you keep using MeKiosk after a change takes effect, the new terms apply. If you're a seller and don't accept them, you can close your account (section 10). If you're a buyer, the terms in force when you place an order apply to that order.
2. Test versions and early access
MeKiosk is released in stages: test versions, early access for sellers we invite, and the full public release. These terms apply at every stage. This section adds what applies only to test versions and early access, where features may change, break or be removed without notice.
Test versions
Versions you install through TestFlight (iPhone) or Google Play's testing tracks connect to our test environment unless we tell you otherwise.
- No real money moves. Payments in the test environment are simulated, and nobody is charged or paid.
- Ghana Card checks are simulated with the test identities shown in the app. Don't enter a real Ghana Card number there.
- Use made-up buyers. Don't place test orders with real people's names or phone numbers.
- We may delete test data at any time, including your test store, products and orders.
Early access and founding sellers
Before MeKiosk opens to everyone, we may invite sellers to use the live service early, with real payments. If you join early access or we make you a founding seller, every section of these terms applies in full, and the founding sellers' fee offer is in section 5.
Feedback
We'd like to hear what works and what doesn't. Anything you suggest, we may use to improve MeKiosk, without paying you or naming you. Please don't publish screenshots of features we haven't released yet without asking us first.
Apple and Google
The App Store, Google Play, TestFlight and Google Play's testing tracks have their own terms, which you accept with Apple or Google. Apple and Google aren't responsible for MeKiosk or for supporting it.
Leaving a test or early access
You can stop testing at any time by deleting the test version. We may end a test or early access, or remove you from it, at any time. Test versions stop working when they expire, such as 90 days after release on TestFlight.
3. Your account
Sections 3 to 10 are for sellers. Your account belongs to you alone, and you're responsible for everything done with it.
- Signing in: you sign in with your phone number and a code we text to it. There's no password. On your phone, the app is protected by a PIN you set and, if you choose, your fingerprint or face.
- One phone at a time: signing in on a new phone signs your account out of the old one.
- Your Ghana Card: before you can take payments, we check your Ghana Card and a selfie against the National Identification Authority's records, through our identity partner Smile ID. You must use your own card. Each card can be used for one store only.
- One store: each seller can have one store, unless we tell you otherwise.
- Your MoMo wallet: payouts go to a Mobile Money wallet registered in your name. If the name on the wallet doesn't match your Ghana Card, we review it and may ask you for another wallet.
- True information: the details you give us must be true and up to date.
Keeping your account safe
Keep your phone, SIM card and PIN safe, and don't share your sign-in codes with anyone. MeKiosk will never ask you for a code.
- If your phone is lost or stolen, use "Lock my store" or message support at once. A locked store can't take payments, and its payouts are paused. To unlock it, you take a new selfie, which we check against your Ghana Card.
- If you change your number, you can move your store to the new number by checking your Ghana Card and selfie again. We'll text your old number to let you know.
- Inactive phones: a phone that hasn't used MeKiosk for 30 days is signed out.
4. Your store and what you sell
You may sell only goods you own or have the right to sell, described honestly, and allowed by Ghana's laws and the list below.
- Your store link is fixed once your store is created, so links you've posted keep working. Store names and links can't pass for MeKiosk, Paystack, a mobile network or another business.
- Your listings must show the real item, its real price and the stock you actually have. Use photos you took or have permission to use.
- Your business: you're responsible for your products, delivery, customer service, and any taxes and permits your business needs.
Items you can't sell
- Weapons, ammunition or fireworks
- Drugs or medicines
- Bleaching creams
- Fake or copied brands
- Alcohol, tobacco or vapes
- ID cards, documents, SIM cards or accounts
- Money, betting or investment schemes
- Stolen goods, wild animals or dangerous substances
- Sexual content
Offensive photos and misleading or fake listings aren't allowed either. We may add to this list; section 1 explains how we tell you about changes.
Your photos and words
You keep ownership of the photos, names and descriptions you add. You give us permission to store, resize and show them on your store, in link previews, in search and in the status images the app makes for you, for as long as they're on MeKiosk. We'll ask you before using your store in MeKiosk's own adverts.
Closing for a while
You can close your store for up to 90 days, or until you reopen it. While it's closed, buyers can't place new orders, but orders placed before you closed can still be paid and must still be delivered.
5. Payments, fees and payouts
Buyers pay you through Paystack, and your share, your price less MeKiosk's fee, goes to your MoMo wallet the next working day.
- When you can take payments: once your Ghana Card is verified and your MoMo wallet is approved. Until then, your store can be visited but buyers can't pay.
- Paystack: payments are processed by Paystack, and you also agree to Paystack's terms for the part they handle. Buyers pay by Mobile Money on your store or on Paystack's own page.
- What counts as paid: only a payment Paystack confirms to us. An order shows "Paid" in the app only then. Never treat a screenshot or a message from a buyer as proof of payment.
Fees
| Charge | Amount | Who pays |
|---|---|---|
| Opening a store, listing products | Free | No one |
| MeKiosk's fee | Currently 1% of your price for each paid order, VAT included. The rate is the one in force when the buyer pays. | You, from your share of the sale |
| Mobile Money payment fee | Paystack's fee, set by Paystack: currently 1.95% of what the buyer pays, VAT and levies included | The buyer, added to your price in their total |
- Your price is the total of the prices you set for the items in an order. Buyers see the Mobile Money payment fee and their total before they pay.
- Where to see the rates: the current rates are on our pricing page, and each order in the app shows what the buyer paid, the fees and what you'll receive.
- Founding sellers pay no MeKiosk fee for 3 months from the day we make them a founding seller, so they receive their full price.
- Fees are subject to change. Before MeKiosk raises its fee or adds a new one, we'll tell you the new rate, VAT included, at least 30 days before it applies. Paystack can change its own fee with 30 days' notice, and we'll pass that notice on.
Payouts
Paystack pays your share to your MoMo wallet the next working day after the payment, never on weekends or public holidays.
- New or changed wallets: the first payout can take longer while it's verified.
- Paused payouts: payouts stop while your store is locked or suspended, and start again when it's unlocked or reinstated.
- Wrong amounts: if a payout is wrong, tell us within 30 days and we'll work with Paystack to fix it.
Money we have to recover
Paystack treats MeKiosk as responsible for every payment on MeKiosk, including yours. If Paystack takes money from us because of one of your sales, you must repay us. That covers a refund, a reversal, a chargeback, a fine or a fraud loss.
- We'll show you what it was for, and you must repay it within 14 days.
- Until you do, we may pause your payouts and your payments.
6. Orders, delivery, refunds and disputes
Once an order is paid, you must deliver what the buyer paid for, as described, in the way and time you told them.
- Unpaid orders hold their items for 15 minutes, then expire, and the items go back on sale. You can cancel an unpaid order at any time.
- Delivered orders: mark an order delivered in the app once the buyer has it.
- Refunds: you can refund a paid or delivered order in the app. The money goes back to the buyer's MoMo wallet, which takes Paystack 3 to 10 working days. The buyer gets back everything they paid, including the Mobile Money payment fee. Fees aren't returned on a refund, so a refund costs you that sale's Mobile Money payment fee and MeKiosk's fee.
- Payments we refund for you: if a buyer pays twice, pays for an order you cancelled, or pays after the items sold out, we refund that payment automatically and text you both.
When a buyer says they weren't delivered
A buyer who paid but didn't get their order can report it. We may open a dispute up to 30 days after the payment, and we'll text you when we do.
- You have 48 hours to deliver the order or send us proof that you did, such as a courier receipt, or a photo of the handover with your chat with the buyer. We'll remind you after 24 hours.
- The buyer then has 48 hours to answer your proof.
- A person at MeKiosk decides. If we find the order wasn't delivered, we refund the buyer in full, and section 5 applies to that refund.
Disputes you lose count towards suspension (section 7). Messages about disputes always come by text, even if you've turned texts off.
7. Reports, removed listings and suspension
We review what buyers report and act when these terms are broken, and a person at MeKiosk makes every decision. We always tell you by text what we did and why.
- Reports: anyone can report a store or a product. A report on its own changes nothing; we look into it first.
- Removed listings: we may take a product off sale if it breaks section 4. You can still edit it, but only we can put it back. If it's a weapon, drugs or medicines, a document or SIM, or sexual content, we also cancel unpaid orders for it.
- Store details: we may rename your store, or remove its logo, about line or delivery note, if they mislead buyers or break these terms. Your store link stays the same.
Suspension
A suspended store shows buyers "This store isn't available right now". It can't take orders or payments, and its payouts pause. Buyers can still see and pay for orders placed before.
We suspend at once for:
- weapons, drugs, documents or sexual content;
- passing for another business, MeKiosk or Paystack;
- evidence of fraud, such as taking payment and never delivering, or fake proof;
- using someone else's Ghana Card;
- a police or court order.
We may suspend after:
- 3 credible reports in 30 days that you haven't answered within 48 hours;
- 3 lost disputes, or 3 removed listings, in 90 days.
If you think we got it wrong, message support. We'll review the decision and reinstate your store if the reason no longer applies.
Support acting for you
If you tell us your phone was stolen, support can lock your store or sign out all your phones for you. We'll text you whenever this happens.
8. Your data and your buyers' data
We handle personal data under Ghana's Data Protection Act, 2012 (Act 843), as our privacy policy explains in full.
- Your Ghana Card: we keep the number encrypted and never show it in full. Your selfie goes straight from the app to Smile ID and is never stored by MeKiosk.
- Who helps us: Smile ID checks identities, Paystack handles payments, SMS companies send texts, Expo, Apple and Google deliver notifications, and Cloudflare stores photos. Each gets only what it needs for that job.
- Your rights: you can ask to see, correct or delete your data, or for a copy of it, by messaging support.
- The law: we share data with the police, courts or regulators only when the law requires it.
Your buyers' details
Orders show you your buyers' names, phone numbers and delivery details. Use them only to deliver the order and answer the buyer's questions.
- Don't add buyers to marketing lists or groups, or share their details, without their permission.
- Keep their details safe, and delete them when you no longer need them.
9. Our service and its limits
We work to keep MeKiosk running and your money safe, but we can't promise it will always be available or free of mistakes.
- Availability: MeKiosk may be down at times for maintenance, or because Paystack, a mobile network, an SMS company or another partner is down.
- Changes: we may add, change or remove features. We'll give you notice before removing anything you rely on to sell, unless we have to act sooner for security or the law.
What we're not responsible for
- your products, their quality, and their delivery;
- what buyers do, including buyers who don't collect or who complain unfairly;
- delays or failures by Paystack, mobile networks or other partners;
- loss of profit or business, or losses we couldn't reasonably have foreseen.
Our total responsibility to you for any claim is limited to the greater of GHS 1,000 and the MeKiosk fees you paid in the 12 months before the claim. Nothing in these terms limits responsibility that Ghana's law doesn't allow us to limit, including for fraud.
Claims about your products
If a buyer or anyone else brings a claim against MeKiosk because of your products, your listings, or your breaking these terms, you must cover our reasonable costs and losses from it.
10. Closing your account
You can close your account at any time by messaging support. We can close it with 30 days' notice, or at once for any reason in section 7's "We suspend at once" list, or when the law or Paystack requires it.
- Before it closes, deliver or refund every paid order. Unpaid orders are cancelled.
- Money owed to you: payouts for paid orders still go to your MoMo wallet.
- Money you owe us under section 5 is still owed after your account closes.
- Your store link goes offline and is never given to another seller.
- Records we must keep, such as orders, payments and Ghana Card check results, stay for the periods in our privacy policy, up to 6 years, then we delete or anonymise them.
Sections 5 (money we have to recover), 9 and 12 still apply after your account closes.
11. Buying from a MeKiosk store
This section is for buyers. You don't need an account to buy, and by placing an order on a MeKiosk store, or paying for an order a seller sent you, you agree to these terms.
Who you're buying from
- The seller, not MeKiosk. Each store is run by an independent seller. Your purchase is an agreement between you and the seller, who is responsible for the item, its description, price, quality and delivery, and for any returns or exchanges.
- Checked sellers. Before a store can take payments, we check its seller's Ghana Card, and that their MoMo wallet is in their own name. That doesn't mean we check or guarantee what they sell.
Placing an order
- Give your real name and phone number and, if you want delivery, an address the seller can deliver to. The seller sees them on the order and may contact you about delivery.
- Prices are in Ghana cedis and set by the seller. Your total is the price plus a Mobile Money payment fee, which covers Paystack's fee (currently 1.95% of what you pay), and you see both before you pay. How the order reaches you, and any delivery charge, is agreed between you and the seller.
- When you place an order, its items are held for you for 15 minutes. If you don't pay in time, the order expires and the items go back on sale.
- Your order page opens with a private link. Anyone with the link can see the order, so keep it to yourself.
Paying
- You pay by Mobile Money through Paystack, our payment provider, on the store's page or on Paystack's own page. You also agree to Paystack's terms for the payment.
- Approve the payment only on your own phone, and never share your MoMo PIN with anyone, including the seller or MeKiosk. We will never ask for it.
- Your order is paid only when Paystack confirms the payment, and your order page shows it.
- If you pay twice, pay for an order that was cancelled, or pay after the items sold out, we refund that payment in full automatically and text you. Refunds reach your MoMo wallet in 3 to 10 working days.
- A refund in full is everything you paid, including the Mobile Money payment fee.
If your order doesn't arrive
If you paid and didn't get your order, use "Report a problem" on your order page within 30 days of paying.
- We ask the seller to deliver the order, or send us proof that they did, within 48 hours.
- If they send proof, you have 48 hours to answer it.
- A person at MeKiosk decides. If the order wasn't delivered, we refund you in full to the MoMo wallet you paid from.
Other problems with an order
If an item is wrong, damaged or not as described, contact the seller first, for example with the WhatsApp button on your order page. Returns and exchanges are up to the seller. You can also report the store to us, and we may act against a seller who breaks these terms (section 7), but we don't promise a refund for these problems ourselves.
Rules for buyers
- Don't place orders you don't intend to pay for, give false details, pay from a MoMo wallet you aren't allowed to use, or make false reports.
- We may cancel an unpaid order that breaks these terms.
Our responsibility to buyers
MeKiosk isn't the seller and isn't responsible for the goods, their quality or their delivery, except for the refunds this section describes. Our total responsibility to you for any claim about an order is limited to the amount you paid for that order. Nothing in these terms takes away rights you have under Ghana's law, or limits responsibility that Ghana's law doesn't allow us to limit, including for fraud.
How we use your details is in section 7 of our privacy policy.
12. Law, complaints and contact
These terms are governed by the laws of Ghana.
- Complaints: sellers, message support in the app. Buyers, use "Report a problem" on your order page, or email support. We aim to reply within 2 working days.
- If we can't settle it, either of us may refer it to mediation under the Alternative Dispute Resolution Act, 2010 (Act 798), with a mediator we both agree on.
- The courts: if mediation doesn't settle it, the courts of Ghana decide.
You can also complain about how we use your personal data to the Data Protection Commission.
